Domestic Worker Rights and Responsibilities
In South Africa, domestic workers are protected by the Basic Conditions of Employment Act and Sectoral Determination 7. Here are some key rights and responsibilities to know:
Rights of Domestic Workers
- Minimum Wage: Domestic workers are entitled to a minimum wage of R25.42 per hour, with a monthly minimum of R4,067.20 for 40 hours of work per week.
- Working Hours: Domestic workers should not work more than 45 hours per week, with overtime paid at 1.5 times the normal hourly rate.
- Leave: Domestic workers are entitled to ¹ ²:
- Annual Leave: 21 consecutive days of paid annual leave per year.
- Sick Leave: 30 days of paid sick leave over a three-year cycle.
- Family Responsibility Leave: 3-5 days of paid family responsibility leave per year.
- Maternity Leave: 4 months of unpaid maternity leave, with UIF benefits available.
- UIF Benefits: Domestic workers are entitled to UIF benefits, with both employer and employee contributing 1% of the employee’s salary each month.
Responsibilities of Employers
- Registration: Employers must register their domestic workers with the UIF and Compensation Fund.
- Payment: Employers must pay their domestic workers at least the minimum wage, with payslips provided monthly.
- Notice Period: Employers must provide written notice of termination, with a minimum of 1 week’s notice for employees with less than 6 months’ service and 4 weeks’ notice for employees with more than 6 months’ service.
- Severance Pay: Employers must pay severance pay of 1 week’s pay for every 12 months of continuous service ³ ².

- Employment Contract: Employers should provide a written employment contract outlining the terms and conditions of employment.
- Deductions: Employers can make deductions for UIF, tax, and other authorized deductions, but cannot deduct more than 25% of the employee’s normal earnings.
